Terms and Conditions
All quotations and sales by Badland Batteries to the customer identified on the quotation, order form, invoice, or other ordering document are subject to these terms and conditions.
1. Payments/Shipment
We accept payments via credit card, PayPal, bank transfer payment, or check. Orders will not ship until our account receives payment, which can take up to 3 business days for bank transfer payments.
Badland Batteries reserves the right to modify terms prior to shipment, require payment in advance, or delay or cancel any shipment or order should customer fail to fulfill any obligation when due.
Badland Batteries will select a carrier and arrange shipping. Freight charges may be constructed based on standard carrier tariffs and may not reflect actual transportation costs. Badland Batteries’ responsibility for any loss or damage ends when products are delivered to the carrier for delivery to customer. Upon delivery, customer will be responsible for and bear the entire risk of loss or damage to the goods.
2. Order Cancellation or Change
No order may be cancelled or modified once it has been processed for packaging and shipment. Once the order has been packed and shipped, the customer will be liable to Badland Batteries for any additional costs and expenses incurred by Badland Batteries.
3. Price and Terms
Product and shipping prices are subject to change without notice in response to supplier price increases. Shipping charges are non-refundable.
4. Limited Warranty
The warranty is limited to one year from the date of sale and limited solely to the parts contained within the product's kit. This warranty covers any manufacturer defect(s) in material(s) or workmanship under normal use during the one-year warranty period. The warranty does not cover normal wear and tear, physical damage, battery failure due to overcharge or discharge, or any damage resulting from improper use or modification of any kind (including opening of a sealed battery pack). The warranty also does not cover damage caused by improper installation, operation, maintenance or attempted repair.
Any attempts at replacing original parts, altering external or internal components, and any other mistreatment of the product voids this warranty.
All products that are in question of warranty must be returned shipping prepaid by the customer to Badland Batteries and must be accompanied by a dated proof of purchase receipt. All warranty claims are subject to approval by Badland Batteries.
Under no circumstances shall Badland Batteries be liable for any labor charged or travel time incurred in diagnosis for defects, removal or reinstallation of this product, or any other contingent expenses.
Third-party transactions are not covered under this warranty. Warranty coverage applies only to the original purchaser and is non-transferable.
Badland Batteries is not liable for damages, loss of profits, production, commercial loss or personal injury in any way connected with the product whether such claim is based on negligence, warranty coverage or otherwise. The CUSTOMER ACKNOWLEDGES AND ACCEPTS ALL RESULTING LIABILITY from the act of using and installing the product.
WARRANTY IS VALID ONLY FOR NEW PRODUCTS PURCHASED THROUGH AUTHORIZED DEALERS (proof of purchase required for all warranty claims).
To make a claim under this limited warranty, the customer must contact Badland Batteries at info@badlandbatteries.com and provide a description of the alleged failure and proof of purchase. Badland Batteries may require additional information regarding the claim, including: diagnostic information, pictures or videos of the damage, and personal information including but not limited to name, email address, address and phone number.
ACCEPTANCE OF THESE TERMS AND CONDITIONS IS AN ACCEPTANCE OF THE WARRANTY AGREEMENT BY THE CUSTOMER.
IN THE EVENT THAT THE CUSTOMER DOES NOT AGREE WITH THIS AGREEMENT: THE CUSTOMER MAY PROMPTLY RETURN THIS PRODUCT, IN A NEW AND UNUSED CONDITION, WITH A DATED PROOF OF PURCHASE, TO THE PLACE OF PURCHASE WITHIN 60 DAYS FROM DATE OF PURCHASE FOR A FULL REFUND.
BADLAND BATTERIES RESERVES THE RIGHT TO MODIFY OR CHANGE THIS WARRANTY WITHOUT NOTICE AND DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED.
THE INSTALLATION OF THIS PRODUCT INDICATES THAT THE CUSTOMER HAS READ AND UNDERSTANDS THIS AGREEMENT AND ACCEPTS ITS TERMS AND CONDITIONS.
5. Processing Time and Delays
Badland Batteries will not be liable for any failure or delay in the delivery or shipment of products, or for any damages suffered by customer when such failure or delay is caused by, or arises in connection with, any fire, flood, accident, riot, earthquake, severe weather, war, act of terror, governmental interference or embargo, strike, shortage of labor, fuel, power, materials, or supplies, delay in delivery by Badland Batteries’ suppliers, or any other cause or causes beyond Badland Batteries’ reasonable control.
6. Miscellaneous
Customer, by accepting any products, making any payments, or ordering any products having previously received these Terms and Conditions, will be deemed to have assented to these Terms and Conditions, notwithstanding any terms contained in any prior or later communication from customer and whether or not Badland Batteries will specifically or expressly object to any of customer’s terms. These Terms and Conditions may be amended only by a written document signed by both parties that specifically references these terms.
